Petitioner seeks bail in connection with Nautan P.S. Case No. 331 of 2019 registered for the offences punishable under Sections 366 A/34 of the Indian Penal Code . The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she has stated nothing against the petitioner, who is languishing in jail custody since 26.11.2019. It is, surprisingly, enough that the learned Sessions Judge rejected the bail petition of the petitioner without taking note of the statement of victim recorded under Section 164 of the Cr.P.C.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.12863 of 2020(2) dt.09-06-2020 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah/concerned court in connection with Nautan P.S. Case No. 331 of 2019.
