The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 120B of the Indian Penal Code.

As per the prosecution case, the son of the informant was forcibly taken away by the petitioner for carrying out the work of tent. It is stated that the next morning the dead body of the son of the informant was brought by accused Raja Kumar who made an attempt to escape but was caught. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. At best the case against the petitioner is one of last seen. There is no eye-witness to the occurrence. The petitioner is in custody since 14.8.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year 3 months, the Court directs the petitioner to be enlarged on bail in connection with Mansurchak P.S. Case no. 87 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai.
