JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Dagarua P.S. Case No.192 of 2019 for offences under Sections 420, 467, 468, 471, 406 and 120B of the Indian Penal Code.
The allegation against the petitioner is that this petitioner has got the land mutated on the basis of false and fabricated sale deed.
Learned counsel appearing on behalf of the informant submits that the report of the Registrar indicates that the documents relating to the sale deed are forged and fabricated. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that
Patna High Court CR. MISC. No.9945 of 2020(2) dt.29-02-2020 2/2 mutation does not create any right and if the informant has any grievance as to right, title and interest, there is remedy available under law and for such mutation of land, lodging of the FIR is pressure tactics.
Considering the aforesaid, this Court is inclined to grant bail to the petitioner. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Dagarua P.S. Case No. 192 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) BT/- U T
