JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 420/272/273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

Liquor was recovered allegedly in the year 2013 and case was lodged. However, petitioner was remanded in this case on 15.12.2016.

Learned Court-below has refused the prayer considering the criminal antecedent of serious cases against the petitioner.

Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.13314 of 2017 (2) dt.22-03-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/Successor Court, in connection with Mirganj P.S. Case No.247 of 2013, giving rise to Trial No.1323 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
