JUSTICE MOHIT KUMAR SHAH) 08-12-2023 The present petition has been filed for modifying the order dated 23.12.2021, passed in CWJC No.6216 of 2021 to the extent that the time granted to the petitioner to file appeal against the order dated 18.01.2021, passed by the Sub Divisional Officer, Sadar, Gaya, be extended by a further period of four weeks from today.

The learned counsel for the petitioner has submitted that on account of non-communication of the order to the petitioner by the learned advocate-on-record of the case in

Patna High Court MJC No.302 of 2022(3) dt.08-12-2023 2/2 time, the appeal could not be filed within the stipulated time frame, nonetheless, the fact remains that the license of the PDS shop of the petitioner, which had stood cancelled by an order dated 18.01.2021, has not been allotted in favour of any other person.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, more particularly, to the effect that the PDS license in question has not yet been allotted to anyone, we deem it fit and proper to extend the time granted to the petitioner to file the requisite appeal, by a further period of two weeks from today.

Accordingly, the present petition stands disposed off with the aforesaid modification in the order dated 23.12.2021, passed in CWJC No.6216 of 2021.
