This is an application for bail in connection with Raushanganj (Banke Bazar) P.S.Case No. 151 of 2016 registered for the offences punishable under Sections 120B of the Indian Penal Code and 25(1b)a, 26, 35 of the Arms Act, including 17 CLA Act.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner, rather there is alleged recovery of 27 live cartridges from the beneath of seat of motorcycle of other co-accused and petitioner has clean antecedent and has remained in custody for about five months.

Having heard both sides and considering the period in custody, let the petitioner, above named, be released on bail on

Patna High Court Cr.Misc. No.10531 of 2017 (2) dt.21-03-2017 2/2 furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Raushanganj (Banke Bazar) P.S.Case No. 151 of 2016, subject to the conditions that :- (i) The bailors of the petitioner shall be local persons having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason and without permission of court, the bail bond of the petitioner shall stand automatically cancelled.
