The petitioners have preferred this application for grant of regular bail in a case registered under section 393 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on a raid being conducted with respect to another case, it is stated that the two petitioners along with others were arrested and from the possession of the petitioner no.1 a live cartridge was recovered. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the

Patna High Court CR. MISC. No.21646 of 2021(2) dt.24-09-2021 2/2 possession of the petitioners. They have been falsely implicated in the case. They are in custody since 11.11.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioners having remained in custody for more than 10 months, the petitioners are directed to be enlarged on bail in connection with Mansi P.S. Case no. 313 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
