ANJANA MISHRA ORAL ORDER 08-09-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners, being the elder brother and sister-in-law of the husband of the deceased, are apprehending their arrest in connection with Sour Bazar P.S. Case No.522 of 2014 (G.R. No.3061 of 2014) for allegedly having committed the offences under Sections 302 and 201/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there is no cogent material available in the case diary so as to connect these petitioners with the alleged occurrence as since long time past, these petitioners have been separate in mess and residence from the family of husband of the deceased. It is further submitted that the husband of the deceased is already in custody and as such,

Considering the aforementioned facts and circumstances and also that there is no cogent material available in the case diary, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S. Case No.522 of 2014 (G.R. No.3061 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
