JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be main assailant and the present case was lodged in the year 2007 but the petitioner could be remanded in this case in the year 2014. Moreover, the impugned order dated 23.01.2017 passed by the Additional Sessions Judge-I, Munger, in Session Trial No. 49B of 2011, arising out of Muffasil P.S. Case No. 219 of 2007, goes to show that the trial of the petitioner is going on and P.Ws.2 and 3, in their evidence, have supported the prosecution case and , therefore, taking note of the aforesaid fact, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Session Trial No. 49B of 2011, arising out of Muffasil P.S. Case

Patna High Court Cr.Misc. No.12999 of 2017 (3) dt.12-04-2017 2/2 No. 219 of 2007, pending in the court of Additional Sessions Judge-I, Munger, stands rejected.

However, the learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible because petitioner is in jail custody since 26.06.2014. (Hemant Kumar Srivastava, J) N.K/- U T
