2. The petitioner seeks regular bail in connection with Kanti P.S. Case No.139 of 2023 lodged under Section 401 of the IPC read with Sections 25(1-b)a/26/35 of the Arms Act.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 18.10.2023 passed in Cr. Misc. No.68056 of 2023 with liberty that he may renew his prayer for bail three months after framing of charge.
4. Learned counsel for the petitioner further submits that the petitioner is in custody since 21.02.2023 having six criminal cases pending against him. He further submits that charge has been framed on 24.09.2024 and even after framing of
Patna High Court CR. MISC. No.17430 of 2025(3) dt.20-06-2025 2/3 charge, no progress has taken place and no witnesses have come forward to adduce evidence.
5. Learned counsel for the State opposes the prayer for bail and submits that the petitioner's antecedent is not clean and 3 months have already been lapsed after framing of charge.

Considering the period of custody and observing that the petitioner has fulfilled all the conditions of the rejection order, let the petitioner above named, be granted bail, on being satisfied by the trial court that the petitioner is not absconding in any of the cases which are pending against them whose details are mentioned below, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Judicial Magistrate-1st Class, Muzaffarpur, West in connection with Kanti P.S. Case No.139 of 2023, subject to the following conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the following conditions:- (i) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bonds by the Trial Court itself;
(ii) the petitioner shall appear before the concerned
Patna High Court CR. MISC. No.17430 of 2025(3) dt.20-06-2025 3/3 police station every month for one year to mark attendance.
