The petitioner seeks bail in Hilsa P.S. Case No.471 of 2019, registered under Sections 461 and 379 of the Indian Penal Code.
The FIR was lodged against unknown for theft of the motorcycle of the informant from in front of the house of the informant. The petitioner was arrested in connection with Fatuha P.S. Case No.676 of 2019 and a motorcycle was recovered from his possession. On verification of Engine Number of the recovered motorcycle, it transpired that the motorcycle is the subject matter of the present case, i.e. Hilsa P.S. Case No.471 of 2019.
Patna High Court CR. MISC. No.9692 of 2020(3) dt.02-06-2020 2/2 It is submitted that the petitioner has already been enlarged on bail in Fatuha P.S. Case No.676 of 2019 in which the stolen motorcycle was recovered. The petitioner is in jail since 08.11.2019. The petitioner has already remained in jail for about seven months.
The learned Additional P.P. however, opposed the prayer for bail.
Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that the petitioner has already remained in jail for about seven months, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa in connection with Hilsa P.S. Case No.471 of 2019.
