====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Buxar (M) P.S. Case No. 005 of 2019, instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Control Act, 2018.

Counsel for the petitioner submits that from seizure list it appears that recovery of foreign liquor has been made from Khalihan of three persons namely, Shyam Bihari Singh, Baijnath Sahu and Haribansh Kusdhwaha.

The seizure list is part of the First Information Report wherein it is mentioned that recovery has been made from Khalihan of Shyam Bihari Singh. Petitioner is alleged to

Patna High Court Cr.Misc. No.10431 of 2019(2) dt.21-02-2019 2/2 have fled away from the place of occurrence. His name has been disclosed by Chowkidar.

Petitioner is in custody since 19.1.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cumSpecial Judge, Excise Act, Buxar, in connection with Buxar (M) P.S.
