The petitioner has challenged the order dated 27.05.2013 passed in connection with Saharsa Sadar P. S. Case No. 404 of 2012 dated 12.07.2012, whereby cognizance has been taken under Sections 420, 467, 468, 469, 471, 385 and 120(B) of the Indian Penal Code. The learned counsel for the petitioner is not aware about the stage of the trial.
In any view of the matter, this Court is not persuaded to interfere with the order of cognizance. No good
Patna High Court CR. MISC. No.16387 of 2015(2) dt.15-05-2019 2/2 ground has been made out for the same.
If the charges have not been framed, the petitioner would be at liberty to prefer a petition for discharge before the court below, if such a petition has not already been filed and disposed off. In the event of the trial in the case having proceeded, the trial court would be under an obligation to conclude the trial as early as possible.
With the aforesaid observation / direction, this petition stands disposed off.
