JUSTICE RAJIV ROY ORAL ORDER 19-08-2025 Learned counsel for the petitioner prays for and is allowed to implead the Arbitrator-cum-Divisional Commissioner, Magadh Division, Gaya as respondent no.7 in course of the day.
2. Heard the parties.
3. The present petition has been preferred for the grant of following relief(s):
"for quashing the awarded dated 12.03.2016 passed under "Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 which is amended award dated 07.07.2014 under section 3G of the National Highway Act,
Patna High Court CWJC No.17747 of 2016(2) dt.19-08-2025 2/2 1956 under Gazette notification dated 08.12.2010 without following mandatory requirements under section 24(2) of the RFCTLARR Act, 2013."
4. After some arguments, learned counsel for the petitioner submits that he shall be approaching before the Arbitrator-cum-Divisional Commissioner, Magadh Division, Gaya for the redressal of grievance in next four weeks.
5. In that background, the writ petition stands disposed of allowing the petitioner to approach the Arbitratorcum-Divisional Commissioner, Magadh Division, Gaya for the redressal of the grievance and if the same is filed in next four weeks, the concerned Arbitrator shall consider the limitation petition taking into account that the matter was pending for nine years before this Court and the same is to be taken to its logical conclusion on merit and be not rejected on the technical ground.
6. Since the matter is a decade old, it is expected that the same will be taken to its logical conclusion by 31st March, 2026.
