The petitioner is accused in connection with Khagaul P.S. Case No. 136 of 2019, registered under Sections 363 and 365 read with Section 34 of the Indian Penal Code. The accusation is that Bikram, aged about eight years, son of the informant, Rita Devi, had gone to shop in the morning of 24.04.2019 but he did not return. In course of search, informant reached at the house Vijay Paswan in village Badipur then Vijay Paswan informed that her son had come at his house wearing torn cloths then he served the food and changed his cloths. Thereafter, his neighbour Chhotan Paswan (petitioner) took the boy for sending him at his house. The

Patna High Court CR. MISC. No.10219 of 2020(2) dt.03-03-2020 2/2 informant raised suspicion about kidnapping her son, who is mentally ill, by Vijay Paswan and Chhotan Paswan (petitioner). Learned counsel for the petitioner submits that while the occurrence is said to be taken in the morning of 24.04.2019 but the informant lodged the present case on 03.06.2019 after more than one and half months, mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 08.07.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Danapur, Patna, in connection with Khagaul P.S.
