2. The petitioner has preferred this application for grant of regular bail in connection with Special Case No. 171/2024 arising out of K. Hat P.S. Case No. 511/2024 dated 14.10.2024 registered for the offence punishable u/s 8(c) and 21(b) of the N.D.P.S. Act.
3. As per the prosecution case, total 47 packets of smack (weighing 12.614 gm.), cash of Rs. 8,523/- and a mobile phone were recovered from the possession of the co-accused, Dhirendra Kumar. The co-accused, Dhirendra Kumar also disclosed that he along with Govind and Ravi Yadav are involved in selling of smack and they get Rs. 700/- per day from
Patna High Court CR. MISC. No.11694 of 2025(2) dt.20-03-2025 2/3 Hemant Yadav for doing so. Thereafter, the informant apprehended Govind Quaiyar with motorcycle. On search, Rs. 5,650/- and mobile phone were recovered. The apprehended person also disclosed that recovered money is sale price of smack provided by Hemant Yadav. In the meantime, the petitioner succeeded to flee away from there.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The seized contraband is less than commercial quantity. The other co-accused person has been granted bail by the Co-ordinate Bench of this Court vide order dated 15.02.2025 passed in Cr. Misc. No. 2814/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.11694 of 2025(2) dt.20-03-2025 3/3 concerned, Purnea in connection with Special Case No. 171/2024 arising out of K. Hat P.S. Case No. 511/2024 dated 14.10.2024, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
