The petitioner is accused in connection with Maniyari P.S. Case No. 268 of 2019, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Judicial Magistrate Ist Class, Muzaffarpur.
The accusation is that Abhishekh Kumar, son of the informant, Raghunath Sahni, had gone for watching Orchestra Programme in the late evening of 08.10.2019. In the early morning of 09.10.2019, Narendra Kumar, villager of the informant, came and informed that his son has been shot fire and he is lying dead pool with blood. The villagers present there
Patna High Court CR. MISC. No.10162 of 2020(2) dt.02-03-2020 2/2 disclosed that Manjit Rai (petitioner) was making firing, which hit in the stomach of his son, Abhishekh Kumar. At that time, Ramu Rai was handing over the loaded pistol to the petitioner. Learned counsel for the petitioner submits that it has come in the statement of witnesses that during Orchestra Pogramme, while petitioner was making firing, in which, son of the informant sustained firearm injury but petitioner had no intention to kill the son of the informant. Further submission is that petitioner is in custody since 18.10.2019. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
