NILU AGRAWAL ORAL ORDER 12-03-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner is languishing in judicial custody since 09.10.2018 in connection with Makhdumpur P.S.Case No.217 of 2018 for the offence alleged under Section 395 of the Indian Penal Code.
The prosecution case as lodged by the informant in his written report is that while he was going to Gaya along with his family members in his car on the way a white Maruti vehicle intercepted and stopped them and four miscreants took them to far away place (barren) and snatched cash, mobile and

It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the FIR and only on extra judicial confessional statement of the petitioner before the police in another case being Makhdumpur P.S.Case No.222 of 2018 he has been made accused in the present case. He submits that nothing has been recovered from his conscious possession and that chargesheet has already been submitted, there being no allegation of tampering with the prosecution evidence. However, learned APP for the State opposes the prayer for bail stating therein that the petitioner does not have a clean antecedent and one more case of similar nature is pending against him although he is on bail in the said case.
Considering the facts and circumstances, nature of allegations and that chargesheet has already been submitted, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Makhdumpur P.S.Case No.
