The petitioners apprehend their arrest in a case under Section 302 and other sections of the Indian Penal Code. The petitioners are named in the F.I.R. but no specific allegation is made against the petitioners. There is no eyewitness of the occurrence. The son of the informant was missing and when the dead body of the son of the informant was recovered, the informant alleged that the accused persons including the petitioners conspired and killed his son. It is submitted that the name of Bandan Kumar is inserted in the F.I.R. later on. Except the hearsay evidence, there is no tangible material against the petitioners.
Learned A.P.P. did not dispute the aforesaid facts.
Patna High Court Cr.Misc. No.14508 of 2015 (4) dt.26-06-2015 2/2 Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Bihar P.S. Case No. 447/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
