The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302, 379, 120B of the Indian Penal Code.
It is alleged that the informant's 5th daughter went out on 24.03.2014 at 10 A.M. to Shophiya Khatoon's place to bring Rs. 5,000/- thereafter she went traceless. The suspicion was raised that co-accused Tasilimuddin, his wife, his sons, his brother-in-law and his son-in-law was came a week ago and abuse and threatened the daughters of the informant. It is submitted by the learned counsel for the petitioners that only on suspicion the accusation has been levelled against the petitioners. There is no eye witness of the
Patna High Court Cr.Misc. No.6550 of 2015 (2) dt.19-02-2015 occurrence. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent and co-accused Taslimuddin has been granted regular bail vide Cr. Misc. No. 39742 of 2014.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Thakurganj (Powakhauli) P.S. Case No. 62 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
