JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2017 The petitioner is in custody since 31.01.2017 in connection with Ahiyapur P.S. Case No. 66 of 2017, registered for offences punishable under Sections 414/34 of Indian Penal Code. It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and has been in custody since 31.01.2017 and has no criminal antecedent.

Learned counsel for the State opposed the prayer for bail and submitted that petitioner was apprehended on chase by the police and witnesses have also supported the prosecution story. Having heard both sides, from perusal of the F.I.R., it appears that on confidential information of sale of stolen vehicle police raided a shop of one co-accused and on seeing the police

Patna High Court Cr.Misc. No.13979 of 2017 (3) dt.10-04-2017 2/2 party, petitioner and other co-accused persons started fleeing away and they were caught and failed to show the genuine papers of vehicles Safari and Scorpio and they were taken into custody, as such, considering these facts, I am not inclined to grant the petitioners privilege of regular bail, it is accordingly rejected. However, the trial court is directed to expedite the trial and try to conclude it as early as possible.
