Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The FIR of the occurrence of theft is against unknown. Petitioner is in custody since 01.04.2017. Submission is that no stolen property was recovered from possession of the petitioner. Only material against the petitioner is his criminal antecedent and all the criminal cases disclosed in paragraph-3 of the bail petition were registered against unknown.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.11329 of 2019(3) dt.06-05-2019 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kotwali Police Station Case No.130 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
