JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-02-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Noorsarai Police Station Case No. 244 of 2015, disclosing offences under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned Counsel for the petitioners submits that the injury has been found to be simple and it is apparent from the First Information Report that the case was instituted because of land dispute between the petitioners and the informant. He further submits that the petitioners have no criminal antecedents and it is undertaken on their behalf that they will neither influence the investigation in any manner nor will they flee away during the investigation and present themselves before the Court as and when
Patna High Court Cr.Misc. No.5969 of 2016 (2) dt.23-02-2016 2/2 required in the case.
Considering the facts and circumstances of the case and the submissions so advanced, this application is allowed.
Let the petitioners, namely, Dhurangi Yadav, Dipu Yadav and Akhilesh Yadav, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Noorsarai Police Station Case No. 244 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present himself before the police/Court, as the same may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
