====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bhagwan Bazar P.S. Case No. 528 of 2017, instituted for the offence under Section(s) 379 of the Indian Penal Code.

Counsel for the petitioner submits that police has registered two cases for the same occurrence. The instant case has been lodged against unknown. There is no recovery of any incriminating article from conscious possession of the petitioner. No Test Identification Parade has been held. The police after investigation submitted final form finding no clue. Counsel for the petitioner further submits that Motorcycle has been recovered from possession of the petitioner for which Chhapra Nagar P.S. Case No. 479 of 2018

Patna High Court Cr.Misc. No.10445 of 2019(2) dt.22-02-2019 2/2 has been registered. The aforesaid Motorcycle is said to be stolen Motorcycle of the instant case and thereafter, the police remanded the petitioner in the instant case.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Saran, Chhapra, in connection with Bhagwan Bazar P.S. Case No. 528 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
