JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 387 of the Indian Penal Code.

The prosecution case is that the informant being a sand and cement dealer was demanded extortion of `5 lakhs through mobile number 756300325 and in case of non-payment, life threatening was also given, subsequently it was found that SIM card of mobile number through which the extortion demand was made was registered in the name of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner is a labourer and he was not aware about misuse of SIM card which was earlier used by the petitioner. The aforesaid facts may constitute ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sheohar P.S. Case No. 152 of 2014 pending in the court of learned CJM, Sheohar. Accordingly, the application is disposed of.
