JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-09-2024 Though the present writ petition has been filed to direct the respondents no.1 to 4 to recall the death certificate of Sheikh Md. Sayeed, however, at the outset, it is submitted by the learned counsel for the respondent-State, by referring to paragraphs no.6 and 7 of the counter affidavit filed in the present case on behalf of respondent nos. 2 and 3, that upon enquiry made by the Panchayat Sevak of Gram Panchayat Raj, Bajda, Gaunaha, he has reported on 22.02.2021, to the Block
Patna High Court CWJC No.22381 of 2018(5) dt.25-09-2024 2/2 Development Officer, Gaunaha, West Champaran that no records are available to show that any death certificate of Sheikh Md. Sayeed was ever issued. It is further submitted that the original writ petitioner, i.e. the deceased-father of the petitioners had also filed a writ petition earlier, bearing CWJC No.10517 of 2017, however the same had stood dismissed for non-prosecution, vide order dated 27.09.2018, thus the present writ petition is not maintainable.
2. Considering the aforesaid facts and circumstances of the case, the learned counsel for the petitioners submits that in case no death certificate of Sheikh Md. Sayeed has been issued, the petitioners are not having any subsisting grievance, hence the present writ petition be disposed off.
3. Accordingly, the present writ petition stands disposed off.
