The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
It is alleged that the accused persons including the petitioner assaulted the informant and when his son came to rescue her he was also assaulted by them and the informant's sister-in-law also received injury. It is submitted by the learned counsel for the petitioner that injury of informant has been found to be simple and superficial in nature. There is counter versions of the occurrence. Statement has been made in
Patna High Court Cr.Misc. No.13086 of 2015 (2) dt.30-03-2015 para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Palanwa P.S. Case No. 24 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
