This is a petition for grant of regular bail for offence under Section 366A of the Indian Penal Code. The minor girl of the informant was found missing while she was returning from the school. Suspicion is there against the petitioner to have induced her to go with him.

Submission of the petitioner is that the petitioner is in custody since 14.12.2016.

The case diary would reveal that there is no eye witness of the occurrence. Every one has raised only suspicion against the petitioner. There is confessional statement of the petitioner before the police, which is no evidence.

Considering the fact that investigation is still going on and the victim is still traceless, I am not inclined

Patna High Court Cr.Misc. No.8641 of 2017 (3) dt.28-03-2017 2/2 to enlarge the petitioner on bail.

The prayer for bail is refused.

The petitioner may renew prayer for bail after submission of the charge sheet.
