This is an application for bail in connection with Chousa P.S.Case No. 178 of 2016 registered for the offences punishable under Section 376 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case as some money was due with the informant and when petitioner demanded the same the false case has been filed as she is a lady aged 25 years having two children and the alleged occurrence took place in broad day light and near the house of the informant. Further medical report does not show any injury on the person of the informant and petitioner is in custody since 20.10.2016. Heard learned APP also.
Patna High Court Cr.Misc. No.10535 of 2017 (2) dt.21-03-2017 2/2 Having heard both sides and considering the nature of allegation and the statement of the victim recorded under Section 164 Cr.P.C., I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same within nine months, if possible on day-to-day basis and the Superintendent of Police, Madhepura is also directed to ensure that the witnesses are produced in court on the dates fixed.
Accordingly, this application is dismissed.
