The petitioners apprehend their arrest in Samastipur Mufassil P.S. case No. 662 of 2018 registered under Section 307 and some other Sections of the IPC.

The informant alleged that while he was sitting on his Darwaja both the petitioners came and abused the informant. When the informant protested, petitioner No.1, Anil Kumar, is said to have assaulted the informant with iron rod on his head. When the mother of informant came, Anil Kumar also assaulted her with iron rod. Prayag Singh, petitioner No.2, is alleged to have snatched ornaments from the possession of mother of informant.

The learned counsel for the petitioners submits that one lacerated wound was found on the right temporal region of the mother of informant. The informant also got one lacerated wound on middle of head. The injury is superficial and simple

Patna High Court CR. MISC. No.15535 of 2019(2) dt.14-03-2019 2/2 in nature. One lacerated wound was also found near right eye and the aforesaid injury is also superficial and simple in nature. The petitioners are next door neighbour of informant. Some altercation took place between two sides for flow of drainage. There is a counter version. The mother of petitioner No.1 filed complaint case.

Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that informant and his mother got simple injuries, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Samastipur in connection with Samastipur (Muffasil) P.S. case No. 662 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
