The petitioner is apprehending his arrest in connection with Ballia P.S.Case no.284 of 2018 , registered for offences punishable under Section 30(a) of Bihar Excise Act, 2016. Allegation against the petitioner is about recovery of huge quantity of liquor form the Chimney Bhata and the name of the petitioner has also been disclosed by the spy as the person involved in the liquor trade.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of information given by the spy and there is no recovery from his house or from the conscious possession and he is not accused in any other similar case, however he got an

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,surrender before the court below within a period of four weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each in connection with Ballia P.S.Case no. 284 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation and shall appear before the police as and when required, otherwise his bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
