Petitioners, in these two applications are apprehending their arrest in connection with a case registered for the offences under Sections 366, 366(A)/34 of the Penal Code, are not named in the First Information Report. From the 164 Cr.P.C.
Patna High Court Cr.Misc. No.9108 of 2015 (3) dt.22-05-2015 2/2 statement of the victim girl (Annexure-3), it appears that petitioner Yadu Mahto is the father-in-law of the main accused and he is said to have assaulted Santosh Mahto when he saw him getting married to the victim girl in a temple.
In the circumstances, petitioner Yadu Mahto is directed to surrender in the court below, thereafter he be released on bail on furnishing bond of Rs. 5,000/-(Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of Sri Anand Kumar Srivastava, Judicial Magistrate 1st Class, Chapra, Saran in connection with Parsa P.S. Case No. 105 of 2014, subject to the conditions laid down under Section 438(2) of the Cr.P.C. So far lady petitioner Deepika Devi is concerned, she is involved in trafficking of the victim girl to the main accused Santosh Mahto, in the circumstances, she is directed to surrender in the court below within four weeks and apply for regular bail which should be considered in accordance with law in the light of the materials collected in the case diary.
