JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 147, 148, 149, 452, 427, 436, 380 and 506 of the Indian Penal Code and Section 3/4 of the Explosive Substances Act as well as Section 17 of the C.L.A. Act. According to FIR, a group of extremists attacked on the house of the informant, damaged the same and committed theft in the house of the informant.

Submission of the petitioner is that only suspicion is there against the petitioner. He has been remanded from some other case only on the confessional statement of co-accused. He is in custody in this case since 23.01.2016.

Patna High Court Cr.Misc. No.12811 of 2017 (3) dt.28-03-2017 Considering the aforesaid facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/Successor Court, in connection with Kutumba P.S. Case No.63 of 2014, subject to the condition that one of the bailors shall be a government servant and another bailor shall be local resident within the territorial jurisdiction of the court below having immovable property and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
