The petitioners apprehend their arrest in Siwan (Muffasil) P.S. Case No. 475 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named fifteen persons including the petitioners and alleged that they all having armed with different weapons surrounded the informant and all the accused persons assaulted him. When Shailesh Chaudhary came to save Vyas Chaudhary who is not petitioner here also assaulted with iron rod on his
Patna High Court Cr.Misc. No.16212 of 2015 (2) dt.30-04-2015 2/2 head. Shailesh Chaudhary also received injuries on his lips. Learned counsel for the petitioners submits that there is no specific allegation of assaulted against the petitioners. Awadh Kishore Chaudhary is alleged to have fired on air. Awadh Kishore Chaudhary is also not petitioner in the present petition. The present case is counterblast of Sadar (Muffasil) P.S. Case No. 396 of 2014. It is further submitted that the informant did not receive any injury. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan (Muffasil) P.S. Case No. 475 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
