====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-04-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 32(3), 33, 41(1), 44, 62 of the Bihar Prohibition and Excise (Amendment) Act, 2022. As per prosecution case, 3.75 litres foreign liquor has been recovered from the house of co-accused Shivam Kumar. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and she has been made accused in the present case merely because she happens to be mother of the co-accused Shivam Kumar. Petitioner claims clean antecedent.
