2. The petitioner seeks bail in connection with Kundawa Chainpur PS Case No. 261 of 2021 instituted for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 325, 307, 379, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, the accused persons along with the petitioner assaulted the cousin brother of the informant by brick on his chest, due to which he became unconscious and fell down on the ground.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of dirty village politics. Petitioner is in custody since 29.11.2023.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR, case diary, seizure list and impugned order of the learned 1st Additional District and Sessions Judge, Motihari, East Champaran dated 15.01.2024 and also the compromise petition in which both parties entered into a compromise which is apparent from Annexure-3 and similarly situated co-accused namely, Bajrangi Rai has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 55825 of 2022 vide order dated 17.05.2023, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-3rd, Sikrahana at Dhaka, East Champaran in connection with Kundawa Chainpur PS Case No. 261 of 2021.
