Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2022 Heard Ms. Rina Sinha, learned advocate for the petitioners and learned Additional Public Prosecutor representing the State.

The petitioners seek bail in anticipation of their arrest in connection with Naubatpur P.S. Case No. 211 of 2020 dated 22.04.2020 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 34 of the Indian Penal Code. The petitioners are said to have assaulted the members of the prosecution party but such accusation is only general and omnibus. There is a specific allegation against other accused

Patna High Court CR. MISC. No.21439 of 2021(2) dt.13-05-2022 2/2 persons.

There appears to be a dispute between the two sides which becomes apparent from the reading of the F.I.R. There is a counter version of the occurrence also vide Naubatpur P.S. Case No. 197 of 2020.

Ms. Singh, learned advocate for the petitioner has also informed this Court that the injuries suffered by the victims of this case have been reported to be simple in nature. Considering the aforenoted background facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Danapur, Patna in connection with Naubatpur P.S. Case No. 211 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
