====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 20-10-2020 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 504/34 of the Indian Penal Code. In the past, prayer for bail was refused to the petitioner on 06.05.2019 vide order at Annexure-1, as specific allegation against the petitioner was of commission of assault with iron rod at the head of the husband of the informant, as result whereof, he died.

Post mortem report reveals that consistent injury was found by the doctor.

The report of the trial Judge reveals that prosecution evidence is already going on.

Since the petitioner is in custody since 12.09.2018, let

Patna High Court CR. MISC. No.9551 of 2020(3) dt.20-10-2020 2/2 the trial Judge expedite the trial and conclude the same preferably within nine months.

If the trial is not concluded within the aforesaid period, the petitioner would be at liberty to renew the prayer for bail.

Hence, for the present, prayer for bail of the petitioner is refused in connection with Manjhauliya P.S. Case No. 381 of 2018 pending in the Court of learned 2nd Addl. Sessions Judge, Bettiah, West Champaran.
