The petitioner seeks bail in Khodabandpur P.S. Case No. 128 of 2016 registered under Sections 307, 120B and 34 of the Indian Penal Code and Sections 27(1-b)a and 27 of the Arms Act.

The informant named three persons Bidya Paswan, Ranjeet Paswan and Ramswaraoop Paswan and alleged that on account of Panchayat Election rivalry, they might have caused the occurrence.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. There is absolutely no material against the petitioner. During the course of investigation, the informant made his statement in Para-21 of the case diary and

Patna High Court Cr.Misc. No.14072 of 2017 (2) dt.12-04-2017 2/2 disclosed that the petitioner might have also participated in the crime. It appears that except suspicion, there is no material against the petitioner.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Mazhaul, Begusarai in connection with Khodabandpur P.S. Case No. 128 of 2016.
