JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 All the above stated petitions arise out of Kishanganj Mahila P.S.Case No. 67 of 2014 registered under section 370, 371,120B of the Indian Penal Code and 3⁄4 of Immoral Trafficking Act and accordingly, both the above stated petitions are being disposed of by this common order.
Patna High Court Cr.Misc. No.10181 of 2015 (4) dt.23-06-2015 2/2 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. According to prosecution case itself four girls were recovered before institution of the first information report but it is surprising enough that the statement of the aforesaid girls was not recorded by the investigating officer. In course of investigation, though the aforesaid girls were produced for medical examination but almost all the girls were found between aged about 17 to 19 years.
Considering the aforesaid facts and circumstances as well as submissions of the parties, both the anticipatory bail petitions are allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Kishanganj in Kishanganj Mahila P.S.Case No. 67 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
