JUSTICE SUDHIR SINGH ORAL ORDER 10-05-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Maranchi P.S. case No.125 of 2015 instituted for the offence under Sections 364, 302 and 201/34 of the Indian Penal Code, pending in the court of Sri Deepak Kumar, A.C.J.M., Barh (Patna).
The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is named in the F.I.R. and the witnesses in paras 166 and 167 of the case diary have stated that the dead body of one of the deceased was carried towards the railway line and the dead body of the other deceased was thrown in the well. The case relates to double murder.
A report was called for from the Trial Court regarding
Patna High Court Cr.Misc. No.11691 of 2017 (4) dt.10-05-2017 2/2 the stage of the case. It has been reported that the charge has already been framed and it is expected that the trial will be concluded within six months.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial within a period of six months from the date of receipt/production of a copy of this order.
The District Magistrate, Patna and the Senior Superintendent of Police, Patna are also directed to take necessary steps to produce the witnesses on the date fixed in the Trial Court so that the trial could be concluded within the stipulated period.
