Petitioners apprehend their arrest in Bochahan P.S. Case No.341 of 2018, registered under Sections 272, 273 and 34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant, A.S.I. of Bochahan Police Station, alleged that he got information that Umesh Rai and his brothers are manufacturing illicit liquor. The informant went to verify the information but the accused persons fled away. Learned counsel for the petitioners submits that the petitioners are residents of village Rudaha Sanathi, P.S. Bochahan but the raid was conducted in a field situated in

Patna High Court CR. MISC. No.11659 of 2019(2) dt.26-02-2019 2/2 village Chaupar Madan. The police obtained the signature of one of the seizure list witnesses of village of the petitioners. It is further submitted that the petitioners have got no manner of concern with the recovery but on account of village politics, all the brothers have been made accused in the case. Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Bochahan P.S.
