The short grievance raised by the petitioner in the instant proceeding is that his claim for grant of senior selection grade with effect from 1.4.1985, when others similarly situated, as the petitioner, were granted the same benefits, has not been considered due to want of service book.
Referring to Annexure 11 of the writ petition, i.e. communication dated 16.8.2012 issued by the office of Accountant General Bihar to Deputy Inspector General of Police (Administration) Bihar, it is submitted that Deputy Inspector General of Police (Administration) was requested to
Patna High Court CWJC No.4456 of 2016(3) dt.16-05-2019 2/2 send the service book or duplicate of the same so that entitlement of the petitioner could be determined/examined. As per petitioner's submission, respondent No. 1 Director, Employment Training (Training Wing) was the parent department of the petitioner. In the circumstances, since claim of the petitioner for grant of senior selection grade has to be considered on the basis of service book and having regard to the limited grievance of the petitioner for making available the service book, the writ petition need not be kept pending. Respondent No. 6 is directed to send the service book/duplicate of the same to respondent No. 1 so as to facilitate the petitioner's consideration for grant of senior selection grade.
Let respondent No. 6 take appropriate steps in this regard expeditiously, without undue delay and preferably within a period of three months from the date of receipt/production of a copy of this order. Direction is being issued to respondent No. 6 since it is the petitioner's case that he last served in the office of Deputy Inspector General of Police (Administration) Bihar, respondent No. 6.
The writ petition stands disposed of.
