JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 10-06-2015 The petitioner apprehends his arrest in relation to Ghoshwari P.S. Case No.41 of 2014 instituted under Section413/414 of the Indian Penal Code. The allegations are that the petitioner was trying to sell a stolen tractor unauthorisedly for which he had taken advance from the informant. After the sale when the informant enquired about the paper, the petitioner left the tractor and tailor abandoned and ran away.

Be that as it may, in the facts and circumstances of the case, I am not inclined to entertain this application. However, if the petitioner, within four weeks from today, may surrender before the Court below and pray for bail, the Court below would consider

Patna High Court Cr.Misc. No.17985 of 2015 (02) dt.10-06-2015 2/2 his prayer on its own merits without being prejudiced by order of this Court.

Accordingly, this application is rejected.
