Petitioners are apprehending arrest in connection with Nautan P.S. Case No. 277 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

In the instant case approximately 20 liters of liquor was seized not from the petitioners.

Learned counsel for the petitioners submits that nothing was recovered from the house of the petitioners. Considering the fact that petitioners have no criminal

No.9849 of 2020(2) dt.29-02-2020 2/2 antecedent and nothing was recovered from their conscious possession, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 277 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
