JUSTICE SATYAVRAT VERMA ORAL ORDER 22-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a), 32(i), 32(3), 41(i) and 41(2) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner has antecedent of nine cases and allegation is of recovery of 1883.520 liter of liquor from a truck. Learned counsel for the petitioner submits that admittedly the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession, petitioner is neither the owner nor the driver of the truck, it is further submitted that earlier also the petitioner was implicated in cases

Patna High Court CR. MISC. No.16743 of 2022(2) dt.22-07-2022 2/2 relating to Excise Act by the police and as such the police in order to save the real culprits again implicated the petitioner falsely in the present case by recording that his name was disclosed by the apprehended co-accused when admittedly petitioner was not present at the place of occurrence. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mahua P.S. Case No. 568 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishik/Shivam/- U T
