The petitioner seeks bail in Aurangabad (T) P.S. Case No. 381 of 2009 corresponding to Sessions Trial No. 26A/ 2012/176/2016 registered under Section 395 of the Indian Penal Code.

The petitioner was granted bail but he could not appear. It was reported that the petitioner was in custody in another case. Therefore, the petitioner did not appear and consequently, his bail bond was cancelled on 13.12.2012. The petitioner is in jail since 01.10.2016 and since then he is in jail. The petitioner has already remained in jail for more than six months for misuse of privilege of bail.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.14797 of 2017 (2) dt.13-04-2017 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VI, Aurangabad in connection with Aurangabad (T) P.S. Case No. 381 of 2009.
