The petitioner is in custody since 27.11.2016 in connection with Bihariganj P. S. Case No. 197 of 2016 registered for an offence under Sections 36 and 37(b) of the Bihar Excise Amendment Act, 2016.

Learned counsel for the petitioner submits that the petitioner was apprehended by the police in drunken condition and 01 liter country made liquor was recovered from his possession. This is his first offence and he has been sufficiently punished. However, learned APP opposed the prayer for bail. Considering the nature of allegation, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount
