The petitioners seek anticipatory bail in a case instituted for the offence under Sections 395 and 397 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that the First Information Report has been filed against unknown. The name of the petitioners has surfaced during investigation in the confessional statement of co-accused Pappu Paswan. Pappu Paswan has already been granted regular bail by a coordinate Bench of this Court vide order dated 12.7.2016 passed in Cr. Misc.23454 of 2016.

No.3530 of 2017 (2) dt.06-02-2017 2/2 From the order of the learned Sessions Judge, it appears that the name of the petitioners has surfaced in the confessional statement of Pappu Paswan. The First Information Report is against unknown. It is alleged that unknown persons committed dacoity in the house of the informant and took away the articles. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Chakai P.S. Case No. 33 of 2015, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2nd, Jamui, subject to the conditions as laid down under Section 438 (2) Cr.
