The petitioner apprehends arrest in a case registered for the offence punishable under sections 457/380 of the Indian Penal Code.
Prosecution case is that all the FIR named accused persons including the petitioner committed theft in the house of the informant and took away house hold items worth Rs.70,000/-.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. From perusal of the FIR, it is apparent that the informant got information about the theft being committed by these accused persons from one Ankit
Patna High Court CR. MISC. No.11874 of 2022(2) dt.16-08-2022 2/2 Kumar Soni. However, one of the co-accused Dipu Sharma has not taken the name of the petitioner in his confessional statement. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Bikramganj, Rohtas in Rajpur Police Station Case No. 84 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
